1. Acceptance of Terms
By downloading, installing, or using the WinStreak application ("the App") or visiting getwinstreak.com ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App or Website.
2. Description of Service
WinStreak is a free Android application designed to help users track habits they wish to quit. The App provides streak tracking, money saved calculations, health milestone information, daily motivational insights, achievement badges, smart notifications, and craving support features. The core App is provided free of charge and is supported by advertising through Google AdMob.
Premium features may be introduced in the future as optional paid upgrades. Core functionality will remain free.
3. Medical Disclaimer
WinStreak is a motivational wellness tool and is NOT a medical application. It does not provide medical advice, medical diagnosis, or medical treatment.
The health milestone information, recovery timelines, and body-related statements in the App are based on general publicly available research and are provided for informational and motivational purposes only. They are NOT a substitute for professional medical care.
If you are experiencing substance dependence, addiction, withdrawal symptoms, or any physical or mental health concerns, please consult a qualified healthcare professional immediately.
WinStreak is not responsible for any health outcomes resulting from use or non-use of the App. In an emergency, contact your local emergency services.
4. Eligibility
WinStreak is intended for users aged 17 and above. The App includes references to alcohol, smoking, gambling, and other adult habit categories. By using the App, you confirm that you are at least 17 years old. If you are between 13 and 17, you may use the App only with the knowledge and consent of a parent or guardian. Users under 13 are not permitted to use this App.
5. Acceptable Use
You agree to use WinStreak only for lawful, personal, non-commercial purposes. You agree not to:
- Attempt to reverse engineer, decompile, or extract the source code of the App
- Modify, adapt, or create derivative works based on the App
- Use the App for any commercial purpose without written permission
- Attempt to circumvent or interfere with the App's functionality or advertising
- Use the App in any way that violates applicable laws or regulations
6. Advertising
WinStreak is free to use and is supported by third-party advertising through Google AdMob. By using the App, you consent to the display of advertisements. WinStreak does not control the content of advertisements displayed. Advertised products and services are not endorsed by WinStreak. Ad data collection by Google AdMob is governed by Google's Privacy Policy.
7. User-Generated Content
WinStreak does not provide any social features, community forums, or public content submission. All data you enter (habit type, daily spend, personal "why", name) is stored only on your device and is never shared with others or with us.
8. Intellectual Property
All content within WinStreak — including the App design, logo, daily insight templates, milestone content, feature names, and website content — is the intellectual property of WinStreak and is protected by applicable copyright and intellectual property laws.
You are not granted any licence to copy, reproduce, distribute, or create derivative works from any WinStreak content without explicit written permission.
9. Privacy
Your use of WinStreak is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
10. Disclaimer of Warranties
WinStreak is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The App will be uninterrupted, error-free, or free of viruses
- Streak data will be preserved under all circumstances (such as device failure, OS updates, or App reinstallation)
- The health information in the App is medically accurate or applicable to your individual situation
- The App will be available at all times or in all locations
11. Limitation of Liability
To the maximum extent permitted by applicable law, WinStreak and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to:
- Loss of streak data or progress
- Reliance on health information in the App
- Loss of savings or financial decisions based on App calculations
- Any health outcomes related to habit changes
- Technical failures or App unavailability
In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, our liability shall be limited to the greatest extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless WinStreak and its developers from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App in violation of these Terms or any applicable law.
13. App Updates and Changes
We may update, modify, or discontinue the App or any of its features at any time without notice. We may introduce premium paid features in future versions. We will not convert existing free features into paid features without reasonable notice.
14. Termination
These Terms remain in effect while you use the App. You may terminate your use at any time by uninstalling the App. We reserve the right to terminate or restrict access to the App for any user who violates these Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the App shall be resolved through appropriate legal channels in the applicable jurisdiction.
16. Changes to These Terms
We reserve the right to update these Terms at any time. We will update the "Last updated" date when changes are made. Significant changes will be communicated where reasonably practicable. Continued use of the App after updated Terms are posted constitutes acceptance of the new Terms.
